By accessing or using ClearedMed (“the Service”), operated by ClearedMed, Inc. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Description of Service

ClearedMed provides informational tools and resources related to FAA medical certification for general aviation pilots. Our services include a Medication Checker, MedXPress preparation tools, BasicMed tracking, condition guides, and an AME directory. All tools are designed to help pilots understand FAA medical certification requirements.

User Accounts

Some features of ClearedMed require you to create an account. When you create an account, you agree to:

• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms or are used for unauthorized purposes.

All content on ClearedMed — including text, tools, graphics, logos, and software — is the property of ClearedMed, Inc. or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or its content without our prior written consent.

FAA regulations and publicly available government documents referenced on ClearedMed are in the public domain. Our original analysis, commentary, and tool implementations remain our intellectual property.

Disclaimers & Limitations of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAREDMED, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.

In particular, ClearedMed shall not be liable for any adverse outcome related to FAA medical certification, including but not limited to denial, deferral, or revocation of a medical certificate, regardless of whether the user relied on information provided by ClearedMed.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in Delaware.
